Case: The client sued his physician, Dr. Steven Rayburn, for malpractice.

Presiding: Judge Paul Resnick
Result: The jury found for the plaintiff in the amount of $320,000.
Notes:
  • The plaintiff, Bill Morgan, was a hypochondriac who had visited his physician 38 times in six months, complaining of various ailments.
  • In settlement discussions, Attorney Mason's initial offer was for $70,000 "as nuisance change". Alan's counteroffer of $125,000 was denied.
  • After Dr. Rayburn's testimony, the offer was raised a mere $5,000. Alan's counteroffer was $300,000 with a kickback of $50,000 to Attorney Mason himself. Mason reacted with outrage although Alan had said it was "entirely possible" he was kidding about the bribe. He also knew Mason wouldn't go to the judge because it would result in a mistrial.
  • Alan gave a stirring closing, which concluded:
"As Dr. Rayburn told you himself, he treated Bill Morgan like a mascot. Opposing counsel regards him as a nuisance. He’s a human being. He’s a human being. We teach our children that everyone is entitled to respect and dignity. How pathetic it is when adults can’t abide such a basic lesson in humanity. How unconscionable."
