Case: The client is a suspect in a convenience store robbery in which the robber was shot; the A.D.A. is seeking a court order to remove the bullet to check for a match against the shop owner's gun.
CP&S Representation: Lori Colson and Tara Wilson
Opposing Counsel: A.D.A. Mark Wills
Presiding: Judge Christine Wilcox
Result: Judge Wilcox found in favour of the client, citing that the risks associated with the removal of the bullet rendered the intrusion unreasonable given the lack of evidence of the client's involvement in the robbery.
Notes:
  • Michael Shea was on probation at the time of the robbery, and didn't want the bullet removed because a match with the shop owner's gun would have meant a 30-year prison sentence.
  • The bullet was the only piece of evidence that the prosecution had to connect Shea to the crime, and Lori Colson successfully argued that such a flimsy connection did not justify the risks associated with the removal of the bullet.
  • Tara Wilson mentioned Shea's predicament to Alan Shore, who gave her the name of a doctor he had previously defended against a drug possession charge. When Shea later arrived at Crane, Poole and Schmidt looking for Lori Colson and the possibility of a plea bargain, Tara saw the deteriorated state he was in, and took him to the doctor, who removed the bullet.
