Notes: Events in this episode:
  • Claire Simms revealed to Dr. Simon that she was on Scott Little's defense team. She asked him for access to Scott's and Brian Hooper's therapy records, in exchange for not being embarrassed in the witness chair. Simon angrily refused the offer.
  • Jeffrey Coho gave Scott one last chance to plead guilty to second-degree murder, but Scott refused to plead guilty to something he didn't do.
  • The trial began with the prosecution's first witness, Detective Richmond. Under Denise's cross-examination, he admitted that the police didn't investigate anybody other than Scott Little.
  • The prosecution then called Brian Hooper, who labelled Scott Little 'unstable' and broke down on the stand while being questioned by A.D.A. Winant. The defense team debated the merits of cross-examining the bereaved widower, but Jeffrey said they had to try to implicate him. Claire did the cross-examination and succeeded in bringing up Marcia Hooper's multiple affairs, the couple's marital troubles, and the question of why Brian Hooper did not call the police immediately after seeing Dr. Simons' video. She asked if he had killed his wife, to which he responded "How dare you".
  • Lincoln Meyer was the next witness. He testified that he'd seen Scott Little and Marcia Hooper having 'angry' sex. In cross-examination, Jeffrey managed to discredit Lincoln by repeating the words from Marcia Hooper's affidavit requesting the restraing order. After Lincoln replied that she was really "drawn to" him, Jeffrey concluded by saying: "Drawn to you? An effeminate loser who plays in his garden all day. You're a peeping Tom, for God's sakes! You should be a registered sex offender! You're a wierd little pervert."
  • The defendant's father, Michael Schiller, testified next and dropped the bombshell of the trial by saying that, two years earlier, he'd caught Scott gratifying himself with a picture of his mother and one of her sweaters nearby. Schiller had reached the conclusion that Scott was sexually attracted to Barbara.
